Terms of Service
These terms govern your use of Mechy, a garage management service operated by Chrysanthos Chrysanthou, a sole trader established in Cyprus, of Strovolos, Nicosia 2021, Cyprus ("we", "us"). By creating an account you agree to them. If you do not agree, do not use the service.
1. WHAT MECHY IS
Mechy is software for running a vehicle repair business: appointments, jobs, inspections, parts, invoicing and reporting. We provide the software. We do not repair vehicles, we are not a party to any agreement between a garage and its customers, and we do not give accounting, tax or legal advice.
2. WHO CAN USE IT
Mechy is for businesses. You must be at least 18 and acting for a business to open an account. The person who registers a garage is its owner and is responsible for everything done under that garage's account, including by staff accounts they create.
Keep your password and any device you have enrolled for sign-in to yourself. Tell us promptly if you believe someone else has access to your account.
3. YOUR CUSTOMERS NEVER GET AN ACCOUNT
Mechy has no customer logins and no customer self-registration. A garage enters its own customer records. Where a customer receives something from Mechy — a link to their vehicle's history, a quotation to approve, a text message about their car — it is sent by the garage using our tools, and the garage remains responsible for what it sends and to whom.
4. PLANS AND PAYMENT
Plans, their prices and their limits are shown before you subscribe. Prices are stated exclusive of VAT unless we say otherwise, and VAT is added where the law requires it.
To open an account you give your name, your shop's name, an email address and a mobile number. No payment card is asked for, and you do not choose a plan. We ask you to confirm both the email address and the mobile number, because they are how you get back into the account if you forget your password, and because an account that can send messages to your own customers in your name should belong to a real business.
Every new account starts on a free trial. Its length and what it includes are shown to you when the account opens, and are also visible in the app while the trial runs. The trial is not the full product: it carries its own limits, which are shown alongside how much of each you have used. Nothing is charged and no card is held. A free trial is available once per account: cancelling or returning later does not start a new one.
The trial ends on the date shown to you. If you have not subscribed by then, the account is not closed and nothing is deleted — you are asked to choose a plan, and the app shows the plan page until you do. You can still export your own records at that point.
Subscribing ends the trial straight away, on the day you subscribe, and the plan's limits apply from that moment. That is a choice you make on purpose rather than a forfeit: the trial is a restricted evaluation, so subscribing early buys back the limits rather than giving up free days. The first charge is taken when you subscribe, at the price shown.
Subscriptions renew automatically for the same period until cancelled. You authorise us to charge your payment method each renewal. We use a payment provider to take payment; card details go to that provider directly and never reach us.
We may change prices. If we do, we will tell you before the change takes effect, and it will apply from your next renewal, never mid-period. If you do not want to continue at the new price, cancel before then.
5. IF A PAYMENT FAILS
This clause applies only once you have paid us at least once. A trial that ends without a subscription is not a failed payment: nothing was owed, so there is no grace period, no lock and no debt — see clause 4.
If a renewal payment fails, your account continues for a grace period so a card problem does not stop work in the middle of a job. During it nothing changes: the shop works normally and every feature of your plan stays available. The grace period is currently 1 day for monthly plans and 3 days for yearly ones. Yearly is longer because a larger charge is more often stopped by a card limit or a fraud check, which usually needs a phone call to your bank, and three days always covers at least one working day. Grace periods end at 07:30 Cyprus time, so an account is never locked overnight or before you open.
If the payment is still outstanding when the grace period ends, the account is locked. Signing in then shows the billing page and nothing else, until the payment is brought up to date. Nothing is deleted, no plan is changed and no staff account is removed, but while the account is locked its records cannot be read from within the app. Paying the outstanding invoice unlocks the account immediately and leaves your renewal date unchanged, so you do not lose the period you paid for.
If the account stays locked and unpaid for a further period, currently 7 days, we cancel the subscription and cancel the outstanding invoice, so no further payment is owed for it. Your data is retained as described in clause 6. You can subscribe again at any time; a new subscription starts a new billing period from the day you pay, and we do not charge for the days the account was unpaid. A free trial applies only to accounts that have not had one before.
If you are locked out and something has gone wrong on our side — a charge taken twice, a card your bank blocked — the Help page stays reachable while the account is locked, and you can reach us from it.
If you move to a smaller plan yourself, the new plan's limits apply immediately, and features beyond them stop being available. This includes staff accounts: if your team is larger than the new plan allows, the most recently added accounts are locked and cannot sign in. They are not deleted, and you can unlock them once you are back on a plan that covers them.
6. CANCELLING
You can cancel at any time from the billing page. Cancellation takes effect at the end of the period you have already paid for; we do not refund part of a period.
After cancellation we keep your data for at least 90 days so you can return or export it. After that we may delete it. If you want it deleted sooner, ask us and we will do so, except for records we are required by law to keep.
Export your invoices, clients and reports before you leave if you want your own copy. The service can do this while your account is open.
7. YOUR RESPONSIBILITIES
You are responsible for the accuracy of what you enter and what you issue. That includes your VAT registration and rates, the invoices and credit notes you produce, the figures in them, and your own tax and record-keeping obligations. Mechy performs the calculations you configure; it does not verify that they are correct for your circumstances.
You are responsible for having a lawful basis for the customer data you enter, and for telling your customers how you use it. Our respective roles are set out in the privacy policy.
Do not use Mechy to break the law, to send messages to people who have not agreed to hear from you, to store data unrelated to running a garage, to attempt to access another garage's data, or to interfere with the service or test its security without our written permission.
8. MESSAGES WE SEND ON YOUR BEHALF
Text messages and emails are handed to third-party providers for delivery. We will show you whether a provider accepted a message and, where a provider tells us, whether it was delivered. We cannot guarantee that any message arrives, or when. Do not rely on a text message alone where the consequence of it not arriving matters.
9. AVAILABILITY
We aim to keep Mechy running and to keep your data safe, and we take backups. We do not promise uninterrupted or error-free service. We may take the service down for maintenance, and will try to do so outside normal working hours where the work allows it.
We may change or remove features. Where a change materially reduces what your plan gives you, we will tell account holders in advance.
10. OUR LIABILITY
Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
Subject to that, we are not liable for lost profits, lost business, lost goodwill, or for any loss arising from your reliance on figures you entered or configured incorrectly. Our total liability to you in any twelve-month period is limited to what you paid us for the service in that period.
Mechy is a business tool sold to businesses, and this allocation of risk is reflected in its price.
11. SUSPENSION AND TERMINATION BY US
We may suspend or close an account that does not pay, that breaks clause 7, or whose use threatens the service or other garages. Except where the problem is serious or urgent, we will tell you first and give you a chance to put it right. If we close your account other than for a breach by you, we will refund the unused part of the period you have paid for.
12. CHANGES TO THESE TERMS
We may update these terms. We will change the date shown on this page and, where a change materially affects your rights, tell account holders directly before it takes effect. Continuing to use Mechy after that means you accept the change.
13. LAW AND DISPUTES
These terms are governed by the law of the Republic of Cyprus, and the courts of Cyprus have exclusive jurisdiction. If you are a consumer rather than a business, this does not remove rights you have under the law of the country you live in.
If something goes wrong, contact us first — most problems are settled faster that way than through a court.
